- SCOPE OF APPLICATION
These General Terms and Conditions shall apply to all contracts between the organizers Lorenz Kommunikation, vgbe energy e.V.. , KWS Energy Knowledge eG and windAdvice GmbH (“Organizer”) with the exhibitor (“Participant”) for events of the Organizer.
- REGISTRATION
2.1 Registration as an exhibitor for the event is only possible with the registration documents provided by the organizer, completed in full and signed with a legally valid signature. The sending of the registration documents is an offer of the participant to an exhibitor contract, which is concluded by the written confirmation of admission by the organizer.
2.2 By sending the registration, the exhibitor accepts these General Terms and Conditions and the “House Rules” as binding. The house rules and the terms and conditions are available for download on the event website.
2.3 The participant agrees that data relating to him/her may be processed and used within the framework of this contract in compliance with the Federal Data Protection Act and other data protection regulations.
2.4 The organizer shall exercise domiciliary rights within the event premises.
2.5 The exhibition package contains only the specified exhibition space. Registration as a participant must be booked separately.
- ADMISSION / PROVISION OF STAND SPACE
3.1 The organizer shall decide on your participation within 14 days in accordance with the provisions applicable to all participants (“admission”). There is no legal claim to admission. If the content of the admission differs from the content of your registration, the contract shall be concluded in accordance with the admission unless you object in writing within two weeks of receipt. The admission is only valid for the respective event, the registered company and the registered products and services.
3.2 The allocation of a stand area is made by the organizer at his own discretion. There is no entitlement to the allocation of a specific stand area at a specific location. If a specific stand area is specified in the admission, this specification is non-binding and the organizer reserves the right to allocate a different stand area.
- ASSEMBLY/DISMANTLING AND DESIGN OF THE STANDS
4.1 Each participant is responsible for the design of the stand, the equipment (including extension cords) and compliance with all relevant statutory or official regulations or orders, in particular those relating to environmental protection, fire prevention and accident prevention. The participant is also responsible for setting up and dismantling the stand and for supervising and guarding the stand at his own expense. Electricity, WLAN etc. are not included in the price. You will receive a separate offer for this.
4.2 The stand must be set up the day before the event. The participant is not entitled to start setting up the stand beforehand or to bring exhibits into the exhibition rooms.
4.3 The stand must be dismantled immediately after the event. The superstructures and objects brought in by the participant must be completely removed from the premises by the participant by the end of the event on the same day at the latest.
4.4 Sound and/or image recordings as well as other recordings and transmissions of the event of any kind require the written consent of the organizer.
- TERMS OF PAYMENT
5.1 The price of the exhibitor packages (“Package Price”) will be invoiced to the participant after admission. Upon receipt of the invoice, the Package Price shall become due for payment in full and shall be paid within ten days without deduction. All prices are net plus the applicable statutory value-added tax (currently 16%).
5.2 In the event of late payment, interest on arrears shall be due at a rate of 8 percentage points above the prime rate of the European Central Bank. We reserve the right to claim further damages for default. Participation is only possible if payment is received before the start of the event. In addition, we reserve the right to assert our claim for payment directly by legal means in the event of default of payment and to charge the costs incurred for this as damage caused by default.
- CANCELLATION
6.1 The participant is entitled to cancel the contract until July 31, 2022. In this case the participant has to pay a cancellation fee of 90 Euro plus VAT. The withdrawal must be declared in writing.
6.2 Withdrawal from the contract after July 31, 2022 is generally no longer possible.
- INSURANCE / LIABILITY
7.1 The organizers do not assume any duty of care for exhibits brought in, for stand equipment and for objects owned by persons working on the stand.
7.2 The insurance of the exhibition goods against all risks of transport and during the event against damage, theft, etc., is the responsibility of the participant.
7.3 The organizers are liable for damages due to breach of contractual or non-contractual obligations or during the initiation of the contract only in case of intent or gross negligence as well as culpable breach of essential contractual obligations. In the event of culpable breach of essential contractual obligations, the organizers shall only be liable for the foreseeable damage typical for the contract, except in cases of intent or gross negligence. Otherwise, the liability of the organizer is excluded. Insofar as the liability of the organizer is excluded or limited, this shall also apply to the liability of its employees, vicarious agents and assistants. The aforementioned limitations of liability shall not apply to damages resulting from injury to life, body and health.
7.4 The participant shall be liable to the organizer for all damages culpably caused by the participant, his legal representatives, employees, agents and vicarious agents, including damages to buildings on the exhibition grounds and their furnishings, and shall indemnify the organizer against claims for compensation by third parties for such damages. This indemnification obligation also extends to any official fines imposed on the organizer in connection with the event.
7.5 The participant is solely responsible for the contents of the advertising material or other information documents of the participant.
7.6 The participant warrants that he/she is entitled to use the logo provided to the organizer under this contract. The participant shall indemnify the organizer against all claims by third parties, including the costs of legal defense, which arise because the participant’s advertising measures, in particular the logo provided by the participant, violate the rights of third parties or other legal regulations.
7.7 The organizer cannot guarantee that a participant named in a press release will be mentioned in the press coverage.
- CANCELLATION, RELOCATION OR EXTENSION OF THE DURATION OF THE EVENT
8.1 The organizers are entitled to cancel the event, to postpone it or to change its duration if there is an important reason for doing so or if force majeure or other unforeseen events for which the organizer is not responsible, such as strikes, lockouts, unavailability of energy or official measures, make this necessary.
8.2 A postponement or change in the duration of the event becomes part of the contract upon notification to the participant. In this case, the participant has the right to withdraw from the contract. The withdrawal must be declared in writing without delay, but at the latest within 14 days after knowledge of the change.
8.3 In the event of cancellation, postponement or change in the duration of the event for reasons beyond the control of the Organizer, the Participant shall be obliged to bear a reasonable proportion of the costs incurred by the Organizer in preparing the event.
8.4 If, due to force majeure or other reasons beyond the control of the Organizer, the Organizer has to shorten an event that has already begun or temporarily or permanently vacate the exhibition area or parts thereof after the event has begun, claims by the Participant for full or partial reimbursement of the Package price shall be excluded.
8.5 Claims for damages against the organizers in the event of cancellation, postponement or change in duration, shortening or evacuation of the event are excluded, unless the cancellation, postponement, change or evacuation was due to intentional or grossly negligent actions of the organizers or their vicarious agents.
- PLACE OF PERFORMANCE / PLACE OF JURISDICTION / APPLICABLE LAW / SEVERABILITY CLAUSE
9.1 Place of performance and jurisdiction is Grevenbroich.
9.2 German law shall apply to all legal relations between you and the organizers.
9.3 If any provision of these General Terms and Conditions is or becomes invalid or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions. In place of the invalid or unenforceable provision, the valid provision that comes closest to the meaning and purpose of the invalid or unenforceable provision shall be deemed agreed.
For Visitors
Conference fees: (All prices exclude VAT per person).
Participation is personal and non-transferable. It is possible to change the number of participants if we are informed in advance in text form, naming the participants concerned. If a participation is divided between two persons on the two conference days, we will charge a fee of 150 € plus VAT per change. We ask for your understanding that in case of a split beyond the indicated number of persons, the full participation fee will be due for each additional participant(s).
Terms of payment:
Payment corresponding to the conference fees due is to be made immediately upon receipt of the invoice without deduction. Cash payment on site is not possible. Confirmation of participation:
After receipt of your registration you will receive a confirmation of participation by mail. The invoice will be sent to you by mail and is payable within ten days without deduction.
Registration:
The participants of the Hydrogen Industry Day will be registered at the reception counter on site. There you will receive the name badges that entitle you to use the booked offers of the event.
Cancellation:
Cancellations received by July 31, 2022 will incur a processing fee of 90 euros plus VAT. The remaining amount will be refunded. After this date, in the event of cancellation, the participation fee will be forfeited and must be paid in full.
Liability:
In any case, the organizers and the promoters act only as intermediaries and are not liable for any loss, accident or damage to persons or property, whatever its origin.
